Imam Shatibi’s View of Concession and its Applications

Abū Isḥāq Ibrāhīm ibn Mūsā al-Shāṭibī (720–790 A.H./1320– 1388 C.E.) was an Andalusi Islamic legal scholar. He performed pivotal role in the development of modern Islamic law. He studied the Islamic jurisprudence and pondered upon its sources and became successful in finding the objectives of Islamic Shariah. Nazriyya-e-Rukhsat is a complex issue and if its rules are not well defined, it goes against the Shariah objectives, in result, a person can commit sin. For this reason, jurists have advised to follow any one fiqh for a lay man, so, he could not commit sin by adopting the concessions of other fiqhs. Imam Shāṭibī based his Nazriyya-e-Rukhsat on objectives of Shariah and on removing difficulty. The objective of this study is to understand Nazriyya-e-Rukhsat of Imam Shāṭibī and explain its importance in current era. This is a qualitative study and data is gathered from secondary sources; books articles and online
sources. Imam Shāṭibī elaborates that following concessions are equal for jurist as well as follower. His approach is to resolve differential issues according to objectives of Shariah.
